Terms of Service

Holihigh Mobile Co., Ltd. and its affiliated companies (collectively, “Holihigh,” “we,” “us,” or “our”) develop, publish, and market interactive entertainment. These Terms of Service (the “Agreement”) set out the terms and conditions under which we provide you with access to and use of our games, applications, products, websites, and other services (collectively, the “Services”). This Agreement is a legally binding contract between you and Holihigh. By accessing our Services, you agree to comply with the terms of this Agreement.

Nothing in this Agreement is intended to limit or exclude any mandatory consumer-law protections applicable in the jurisdiction where you reside. If you do not agree to all of the terms of this Agreement, you may not use the Services or any part of them.

Please read this Agreement carefully, with particular attention to the following section:

Section 4 — User Rules. This section sets out your obligations when using our Services and helps us ensure that our social and online gaming experiences are inclusive and respectful for all users, employees, and contractors. You must comply with Section 4, including its code of conduct, when using the Services.

1. Your Use of the Services

1.1 Age Restrictions and Legal Responsibility

In this Agreement, “you” and “your” refer to the individual user interacting with our Services. If that user is under 18 years of age (or the minimum legal age of majority in your country), “you” and “your” instead refer to the user’s parent or legal guardian, who enters into this Agreement on the user’s behalf.

You, or any person under your supervision, may use a Service only if you or that person meet the minimum age rating applicable to that Service. Minors under 18 years of age (or the legal age of majority in their country) must ask their parent or guardian to review and explain this Agreement to them and to agree to it on their behalf. If you accept this Agreement on behalf of a minor, you must supervise that minor’s use of the Services. If you are the parent or guardian of a minor and agree to this Agreement on the minor’s behalf, you agree that you are responsible for all use of the Services, whether or not your child’s use was expressly authorized by you. You are legally and financially responsible for all actions taken while using or accessing the Services, including actions taken by any person you permit to access them.

1.2 Changes to This Agreement

We reserve the right to amend this Agreement, in whole or in part, at any time. We will endeavor to notify you of any such amendment before the amended Agreement takes effect. If you do not agree to the amended terms, you may no longer be able to access the Services once the amended Agreement becomes effective. When we notify you of an amendment, we will endeavor to explain its legal consequences. By affirmatively accepting the amended Agreement or continuing to use the Services after it becomes effective, you agree to be bound by the amended terms. If you do not agree to the amended Agreement, you may stop using the Services without owing us any fees.

2. Limited License

2.1 We Retain All Intellectual Property Rights

We and our licensors own and retain all right, title, and interest in and to the Services, Virtual Items, and Content (excluding any tangible medium on which the Services may be supplied), including all: (1) information, text, data, files, code, scripts, designs, graphics, artwork, illustrations, photographs, sounds, music, titles, themes, objects, characters, names, dialogue, locations, stories, plots, animations, concepts, audiovisual effects, Virtual Items, in-game currency (including Virtual Items), interactive features, gameplay, methods of operation, compilations, assemblies, arrangements of Service materials and Virtual Items, and all other copyrighted materials; (2) trademarks, logos, trade names, trade dress, service marks, and trade identities, including those of Holihigh; and (3) other forms of intellectual property (collectively, “Content”).

2.2 Personal, Non-Commercial Use

Subject to the terms of this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal, non-commercial entertainment. The Services, Virtual Items, and Content, excluding any tangible medium on which the Services may be supplied, are licensed, not sold. This license is personal to you only and does not give you any ownership interest in the Services.

2.3 Restrictions

The limited license granted under this Agreement does not grant you any right to sell, copy (except where an applicable legal exception applies, such as a “private copy” exception under applicable law), lend, rent, distribute, disassemble, decompile, decrypt, crack, derive source code from, reverse engineer (except as permitted by applicable legal exceptions, including those arising under EU Directive 2009/24 or other applicable law), modify, create derivative works from, commercialize, or otherwise exploit the Services (including Content), unless separate written terms from Holihigh expressly permit such conduct.

Without limiting the foregoing, the limited license granted under this Agreement does not authorize use of the Services (including Content), Virtual Items, or your materials in any manner to develop, train, or promote any generative artificial intelligence tool or as source material for any such tool. For the avoidance of doubt, any such use is expressly prohibited. “Generative artificial intelligence tool” means any tool or computer program that uses algorithms or technology commonly known as artificial intelligence or machine learning to create or generate content, including software code, written text, static or moving images, musical works, voice simulations, audio materials, or other content based on text, image, audio prompts, or other inputs. If we terminate this Agreement, any license we grant you to use the Services, Virtual Items, or Content will immediately end.

2.4 Legal Effect

This license describes certain legal rights. You may have other rights under the laws of your state or country. This license does not change your rights under the laws of your state or country where those laws do not permit it to do so.

3. User-Generated and Custom Content

3.1 User-Generated Content

“UGC” includes all content that you create, upload, or distribute through the Services, including text, posts, audio or audiovisual communications; code, scripts, textures, models, maps, files, or other resources or documents; photographs, images, videos, or other audio or audiovisual works; and any feedback or suggestions related to the Services. UGC expressly excludes Custom Content, as defined below. You are solely responsible for UGC that you create, upload, or distribute through the Services (“Your UGC”), and you represent and warrant that Your UGC will not violate this Agreement, including Section 4.

3.2 Rights in UGC

You retain any rights in Your UGC that you may have under applicable law. If you have any such rights in Your UGC, including copyright or other intellectual property interests, then, in exchange for the rights granted to you under this Agreement, you grant us an irrevocable, worldwide, royalty-free, non-exclusive, sublicensable right to use, reproduce, edit, modify, adapt, create derivative works from, publish, distribute, transmit, publicly display, communicate to the public, publicly perform, and otherwise exploit Your UGC through the Services or for any other commercial or non-commercial purpose related to the Services, including to improve the Services, without compensation or notice, for the full term of the intellectual property rights in Your UGC (including all renewals, reversions, and extensions of those rights).

Without limiting the foregoing, the rights granted to Holihigh expressly include the right to allow other users to use Your UGC as part of our operation of the Services. By creating, uploading, or distributing Your UGC through the Services, you represent that you own, separately and without encumbrance, all rights in Your UGC necessary to grant us the rights in this Section, and that our exercise of those rights will not infringe or violate the rights of any third party.

3.3 Custom Content

Some Services may allow you to use our tools, editing software, in-game features, or other functionality we provide (collectively, “Our Tools”) to create or edit, for example, custom levels, maps, in-game content assets, designs, clothing, characters, liveries, tracks, games, or other content based on Content (“Custom Content”). Custom Content includes, without limitation, all content created using Our Tools, including in-game assets, maps, screenshots, videos, in-game audio recordings, gameplay clips, and livestreams. You may use Custom Content only within the Services and/or as otherwise authorized by us. You are solely responsible for the Custom Content you create and agree that it will not violate this Agreement, including Section 4.

3.4 Rights in Custom Content

Holihigh retains all right, title, and interest in and to all Custom Content to the extent permitted by applicable law. If, under applicable law, your creation of Custom Content gives you any intellectual property rights in that Custom Content, then, in exchange for the rights granted to you under this Agreement, you hereby assign to us, free of charge and upon creation of such Custom Content, all right, title, and interest in and to that Custom Content, including all intellectual property rights worldwide for the full term of those rights (including all renewals, reversions, and extensions).

If, despite the foregoing assignment, you retain any intellectual property interest or other right in Custom Content, you grant us an irrevocable, worldwide, royalty-free, non-exclusive, sublicensable right to use, reproduce, edit, modify, adapt, create derivative works from, publish, distribute, transmit, publicly display, communicate to the public, publicly perform, and otherwise exploit that Custom Content through the Services or for other commercial and non-commercial purposes related to the Services, including to improve the Services, without compensation or notice, for the full term of the intellectual property rights in that Custom Content (including all renewals, reversions, and extensions of those rights). Without limiting the foregoing, the rights expressly granted to Holihigh include the right to allow other users to use such Custom Content as part of our operation of the Services.

3.5 Content Moderation; Right of Removal

We have no obligation to host, maintain, support, or distribute any UGC or Custom Content that you create. We are not required to review, and have no obligation to actively monitor, UGC or Custom Content made available through the Services. We do not verify the safety, quality, or originality of any UGC or Custom Content. UGC and Custom Content do not represent the views of Holihigh, its management, employees, or any other person associated with us.

You understand that we may modify, take down, suppress, block, hide, delete, or remove any UGC or Custom Content, and report any unlawful UGC or Custom Content and related user information to the relevant authorities. Consistent with our obligations under applicable law, if we take adverse action with respect to Your UGC or Custom Content, suspend or ban your use of the Services, or otherwise limit your access to some or all Services or Virtual Items because of Your UGC or Custom Content, we will endeavor to notify you.

4. User Rules

For purposes of this Section 4, “Services” includes Virtual Items, and “Material” means Your UGC and any Custom Content you create.

4.1 No Illegal Conduct or Unauthorized Commercial Exploitation

You agree that:

You will use the Services only for lawful purposes and in compliance with applicable law.
You will not use the Services for any wager of money or other item of value, unless separate written terms from Holihigh expressly permit that conduct.
You will use the Services for personal, non-commercial purposes and will not commercially exploit the Services unless separate written terms from Holihigh expressly permit that conduct. This includes participating in, supporting, or encouraging the collection, sale, or exchange of any Service content (including, without limitation, Virtual Items) that is not expressly authorized by Holihigh; facilitating, creating, or maintaining any unauthorized connection to the Services (including through unauthorized modification, emulation, or other connection to a Service); and creating or participating in any practice that exploits price differences for Virtual Items in any manner (for example, between real-world currencies).

4.2 Respect for Intellectual Property

You agree not to use the Services to create, upload, or distribute any Material that infringes any third party’s copyright, trademark, or other intellectual property rights, or otherwise violates Section 5.

4.3 Code of Conduct

You agree that:

You will not use improper or unauthorized means to interfere with or adversely affect another user’s ability to use the Services as intended; obtain an unfair gameplay advantage; or obtain Virtual Items or other Content to which you have no valid entitlement. This includes the use of cheats, unauthorized mods, hacks, glitches, or other technical exploits, as well as phishing, fraud, or social engineering.
You will not use the Services to create, upload, or distribute Material that infringes or violates another person’s privacy. This includes “doxxing,” meaning sharing or threatening to share information to shame, intimidate, harm, or harass another person.
You will not use the Services to create, upload, or distribute Material that you know or intend to be misleading, false, or fraudulent. You will not use the Services to “spam,” meaning repeatedly or periodically misusing them to disrupt or interfere with the operation of the Services, advertise any third-party product or service, or adversely affect another user’s ability to use the Services as intended.
You will not use the Services to create, upload, or distribute Material containing actual or realistically depicted gore, excessive violence, torture, or animal abuse. This includes depictions of all such content, whether the Material is real or fictional, animated, computer-generated, or created using other digital technologies.
You will not use the Services to create, upload, or distribute Material that depicts, promotes, or attempts to normalize, encourage, or knowingly cause eating disorders, suicide, or other acts of physical self-harm. This includes Material that could reasonably be understood to promote or encourage another person to physically harm or starve themselves; consume dangerous amounts of alcohol, drugs, or other substances; or engage in, or be threatened with, self-harm to intimidate, manipulate, or coerce another person.
You will not use the Services to create, upload, or distribute Material, or engage in conduct, that is abusive, bullying, harassing, or could reasonably be understood as a physical or verbal threat to another person. This includes defamatory Material and conduct such as camping, griefing, stream sniping, swatting, or other abusive in-game conduct.
You will not use the Services to create, upload, or distribute Material, or engage in conduct, that is pornographic, obscene, or sexually harassing. This includes distributing unsolicited or unwanted sexually suggestive Material; making unsolicited or unwanted sexualized comments about another person; making threats or attacks based on a person’s actual, perceived, or assumed sexual orientation or sexual activity; or sharing another person’s sexually suggestive or explicit content without authorization or consent (for example, “revenge porn”).
You will not use the Services to create, upload, or distribute Material that depicts, promotes, attempts to normalize, encourages, or knowingly causes the sexual abuse of minors. This includes any form of sexualized content involving minors, whether real or fictional, animated, computer-generated, or created using other digital technology; engaging in or attempting sexually suggestive or explicit communications with minors; and soliciting sexually suggestive material from or involving minors.
You will not use the Services to create, upload, or distribute Material, or engage in conduct, that constitutes hate speech or conduct. We define this as any form of expression that could reasonably be understood to attack, promote hatred against, or advocate violence against an individual or group based on any of the following characteristics: age; color or race; disability; ethnicity; gender or gender identity; nationality or immigration status; religious beliefs; sex or sexual orientation; military service; socioeconomic class, status, or caste; or weight, body size, or body shape.
You will not use the Services to create, upload, or distribute Material that depicts, promotes, or supports violent extremism or terrorism. This includes any Material or conduct that could reasonably be understood to endorse or support extremist violence or persons who commit such acts, or to promote extremist ideologies or conspiracy theories that encourage or incite violence against others.
You must comply with any additional rules that may apply to your use of a particular game, application, product, or website within the Services. All such rules are incorporated into this Agreement by reference.
In addition to the foregoing, you will not use the Services to create, upload, or distribute any other Material, engage in any unlawful conduct, or use the Services to attempt or conspire to commit any violation of this Code of Conduct.

4.4 No Technical Exploits

You agree that:

You will not use IP proxies or other methods to disguise your location or place of residence, including to circumvent geographic restrictions on access to Content, access controls, or technological protection measures, or to engage in activities that are unlawful under applicable local law.
Unless separate written terms from Holihigh expressly provide otherwise, you will not use the Services, or transmit copies of any Content, to a remote server, virtual computer, or other system or network, including to enable (or claim to enable) the Services or Content to be downloaded or streamed to one or more separate networked devices.
You will not use, promote, or make available any exploit, glitch, vulnerability, cheat, hack, script, bot, unauthorized mod, or other method designed to interact maliciously with the Services, including to violate this Agreement; collect information or user data; exploit system vulnerabilities; bypass content moderation or filtering systems; or otherwise intercept, redirect, or interfere with operation of the Services.
You will not reverse engineer, decompile, or disassemble (except as permitted by applicable legal exceptions, including those arising under EU Directive 2009/24 or other applicable law), display, perform, prepare derivative works based on, or otherwise modify the Services without our express prior written consent.
You will not use the Services to distribute, upload, or transmit any software, scripts, code, or other information (including viruses, worms, time bombs, cancelbots, Trojan horses, hacks, or other harmful code) to modify or alter the Services in any unauthorized manner, or to transmit such information.

4.5 Supporting or Encouraging Violations

You agree not to provide material support to another user in violating or attempting to violate this Agreement. This includes providing financial support; professional expertise or other assistance; or repeatedly encouraging conduct that violates this Agreement.

4.6 Application to Employees, Agents, and Contractors

For clarity, the conduct rules in this Section 4 apply to your communications and interactions with Holihigh employees, agents, and contractors, including, without limitation, persons on our customer support, engineering, safety, or community teams.

4.7 Consequences of Violations

If you violate this Agreement, including, without limitation, the User Rules in this Section 4 as amended from time to time, Holihigh reserves the right to take adverse action against you, including, without limitation: resetting some or all in-game progress associated with you; suspending your access to some or all Services or Virtual Items; terminating your access to some or all Services or Virtual Items or closing your account under the termination provisions below; prohibiting you from accessing the Services in the future; or taking appropriate legal action to enforce this Agreement or our other rights under applicable law.

We may notify law-enforcement agencies, governmental agencies, or other regulatory authorities, and provide relevant personal data as described in our Privacy Policy, if a disclosure involves a threat to the life or safety of yourself or others, or any activity we believe to be unlawful. We reserve the right to take adverse action against you based on information we receive from third parties, including other users, law-enforcement agencies, governmental agencies, or other regulatory authorities. We are not responsible for any violation of this Agreement by you or other users.

4.8 Monitoring; User Tools and Automated Systems

We may, but are not obligated to, actively monitor the Services for various purposes, including preventing cheating and hacking; ensuring your compliance with this Agreement; enforcing the terms of this Agreement; and continually improving the Services.

The Services may use moderation and filtering systems, such as automatic word filters and content or symbol recognition software, designed to prevent or stop Material that violates this Agreement. The Services may also include tools that enable users to control interactions with other users, such as allowing users to opt into in-game text chat or voice communication, or allowing users to “mute” or block other users. The Services may provide reporting tools, either in-game or through a dedicated support website, that allow users to report conduct violating the Code of Conduct for our review.

The above features and tools may contain algorithms, artificial intelligence, machine learning, or other automated systems that help us achieve the objectives described here and effectively maintain the Services for users.

The moderation and filtering systems for each Service may vary based on content, age rating, or the intended audience for that Service. More information on how we monitor the Services and use collected data is available in our Privacy Policy.

5. Content Reports; Takedown Requests; DMCA

5.1 Harmful or Unlawful Content

If you become aware of any UGC or Custom Content in the Services that violates the User Rules in Section 4 of this Agreement, including the Code of Conduct, you may notify us using the reporting tools available in-game or through our relevant customer-support website. Please visit our Customer Support site for more information about reporting UGC or Custom Content that violates the User Rules. By submitting such a notice to us, you confirm that you have a good-faith belief that the UGC or Custom Content you report violates this Agreement and that the information in your notice is accurate and complete.

5.2 Repeat Infringer Policy

If you repeatedly violate this Agreement, for example by infringing our intellectual property rights, the Code of Conduct, or the rights of third parties, we reserve the right to take adverse action against you, including, without limitation: suspending your access to some or all Services or Virtual Items; closing your account under the termination provisions below; prohibiting you from accessing the Services in the future; or taking appropriate legal action to enforce this Agreement or our other rights under applicable law.

6. Updates and Features

6.1 Updates and Modifications

We may provide patches, updates, or upgrades to the Services or Virtual Items that may be required for your continued use of the Services, including automatic or “background” updates without notice to you. Unless otherwise stated, any such updates are governed by this Agreement as updated. We have no obligation to provide any update. We do not guarantee that we will support the system version or device on which you access, acquire, or purchase any part of the Services, unless we have made a representation that it is suitable.

From time to time, and at no additional cost to you, we may modify, alter, or suspend, in whole or in part, any of our Services or Virtual Items for valid reasons. Valid reasons include, without limitation: improving our Services or Virtual Items (including providing new Services, Virtual Items, or Content); changes for game balance, bug fixes, or prevention of or response to cheating; changes resulting from a new technological environment or an increase or decrease in the number of users; suspected or actual intellectual-property infringement; changes to licenses we hold from third parties or other third-party compliance requirements; termination of agreements between us and third parties for reasons beyond our control; discontinuation of services or features provided by third parties in connection with our Services or Virtual Items; specific and verifiable changes in open-market costs; necessary enhancements for the safety of users or other third parties; or other material, legal, regulatory, or security reasons.

6.2 Automatically Generated Players

As part of the Services, we may give you the opportunity to play with friends or against matched opponents. To ensure that opponents are available at appropriate skill levels, some matched opponents may be automatically generated, computer-controlled players that look and play like real people.

6.3 Availability

The Services, Virtual Items, and Content may be offered for a limited time and may vary by region or device. If you change regions, without affecting our portability obligations under applicable law or your arrangements with the relevant digital storefront, you may need to reacquire certain Virtual Items or Content that you previously obtained or purchased in your former region. Similarly, if you change regions, you may no longer be able to access certain Services, Content, or Virtual Items that were available in your former region if the applicable laws of your new region prohibit those Services, Content, or Virtual Items.

6.4 Third-Party Services

Through the Services, you may have the opportunity to access or enable content, software, applications, products, websites, platforms, features, and services operated by third parties that are not part of Holihigh and are not under our control (“Third-Party Services”). If you choose to access, transact with, facilitate, or otherwise interact with any Third-Party Service, you understand that you are directing the applicable third-party entity to make that Third-Party Service available to you. You are responsible for your interactions with third parties.

When you use our Services to access a Third-Party Service, any applicable terms of use associated with that Third-Party Service will govern your use of it. We do not endorse any Third-Party Service offered or promoted on or through the Services. We do not grant you any rights in Content owned by a third party as part of a Third-Party Service, and we are not responsible to you or others for any Third-Party Service or for any results, information, Content, or interactions you may encounter while using it. Any concerns you have about results, information, Content, or interactions you may encounter while using a Third-Party Service should be directed to the provider of that Third-Party Service.

6.5 Internet-Based Services

The Services may require an Internet connection through a wireless or cellular network and may therefore obtain certain standard information about the device, system, and software you use to connect to the Services. We collect and use this information in accordance with our Privacy Policy. You are solely responsible, at your own expense, for maintaining your Internet connection and paying any usage charges that may arise from accessing the Services through any wireless or cellular network.

6.6 Third-Party Advertising

Some Services may include advertisements for, or links to, third-party websites, Content, goods, promotions, or services (“Third-Party Advertisements”). We do not control and are not responsible for the content of any Third-Party Advertisement. The inclusion of Third-Party Advertisements in the Services does not mean that we endorse or approve those advertisements or the websites, Content, goods, promotions, services, or business practices of their third-party providers.

7. Your Responsibility to Us

You agree to defend, indemnify, and hold Holihigh harmless from all direct liabilities, damages, and losses arising out of or related to: (1) your breach of this Agreement; (2) any information or Content you provide that infringes a third party’s rights when we use it under this Agreement; and (3) your unlawful acts or omissions. We may, at our own expense, assist in defending any matter for which you are required to indemnify us. In that event, you agree to cooperate with us, and we will take reasonable measures to mitigate losses.

However, you have no obligation to indemnify Holihigh for any liability, damage, or loss arising out of or related to negligent acts or omissions, fraud, or willful misconduct by Holihigh, its officers, contractors, or agents, or where you are not responsible for the breach. You are solely responsible for any third-party charges incurred through your use of the Services or Virtual Items.

8. Termination

You may stop using the Services or Virtual Items and terminate this Agreement by destroying or deleting any copies of Materials or software in your possession and/or by deleting your account. You may also request that we delete your personal information at any time in accordance with our Privacy Policy.

For any Services or Virtual Items provided to you for an indefinite period, we have the right, in our sole discretion and at any time for any reason, to terminate this Agreement and your access to the Services or Virtual Items, or to discontinue providing such Services. Where we have reasonable means of contacting you and it is practicable to do so, we will endeavor to notify you reasonably in advance of any such termination or discontinuation. Where advance notice is not possible, we will endeavor to notify you as soon as possible thereafter.

If your habitual residence is in Germany, either party’s right to extraordinary termination for good cause remains unaffected. Good cause exists where, taking into account all circumstances of the individual case and balancing the interests of both parties, the terminating party cannot reasonably be expected to continue the contractual relationship until the agreed termination date or expiry of the notice period.

We may immediately terminate or suspend your access to any or all Services, Virtual Items, Content, and/or your account if you breach this Agreement; use Virtual Items or the Services fraudulently, unlawfully, or for purposes other than their intended purpose; initiate any adverse legal action against us; or if we have a legal obligation to do so. If we decide to terminate or suspend your access to some or all Services or Virtual Items, we will endeavor to notify you in advance of that termination or suspension unless the action is based on a legal obligation that prevents us from notifying you, or advance notice is not practicable.

You acknowledge and agree that, if this Agreement is terminated (or if we terminate your right to access any Services, Virtual Items, Content, or your account under this Agreement), the licenses granted to you under this Agreement (or in respect of those Services, Virtual Items, or Content) will immediately terminate.

9. Photosensitive Seizure Warning

A very small percentage of people may experience epileptic seizures when exposed to certain light patterns or flashing lights, including some visual effects that appear in certain video games. Symptoms may occur even in individuals with no history of epilepsy or photosensitivity. If you or anyone in your family has epilepsy or photosensitivity, consult a doctor before playing any of our video games.

If you experience any of the following symptoms while playing one of our video games, stop using it immediately and consult your doctor before resuming play: dizziness, altered vision, eye or muscle twitching, loss of awareness, disorientation, any involuntary movement, or convulsions.
